Estates, Trusts, and Probate Litigation

Our attorneys have the proven experience to guide clients through all aspects of estate planning, business succession, estate and trust administration, and probate litigation.

We represent clients in creating estate plans through the use of wills, trusts, and other tools that are tailored to fit the client’s specific needs, whether simple or complex. Based on the client’s goals, including their intended beneficiaries and desire for future flexibility, we design and implement plans that meet the client’s objectives in a cost-effective and tax-advantageous manner. We further represent individuals, entrepreneurs, and private business owners with respect to the legal and tax issues involved in business succession planning.

Our attorneys serve as, and provide representation to, executors, trustees, and guardians. We have substantial experience with the administration of full probate estates, various types of trusts, and guardianships, including the preparation of associated tax returns.

Claims against fiduciaries have been steadily increasing, and our attorneys regularly represent executors, trustees, and guardians in removal actions and in litigation alleging claims of breach of fiduciary duty and breach of trust. We defend fiduciaries in state and appellate courts, including in adversarial proceedings before the probate court. We also provide proactive consulting for fiduciaries on issues concerning their ethical duties and legal obligations.
