Maritime and Admiralty Law+

Gallagher Sharp's maritime and admiralty attorneys handle all types of litigation throughout the Great Lakes.  We represent vessel owners in the defense of Jones Act claims, Petitions to Limit Liability and Limitation of Liability Proceedings, vessel sinkings and groundings, crew mutinies, stowaways on vessels, marine salvage, COGSA and NVOCC transit and cargo claims, attempted seizures and boardings by the Coast Guard, and customs issues involving vessel owners.  We handle matters involving common carrier liability for passenger vessels and pleasure boat accidents. We defend wharf and dock owners in claims involving breach of duty and marina liability.  We have also represented officers and captains in licensing disputes.

Railroad+

The firm’s railroad attorneys have substantial experience in a wide variety of cases relating to personal injury, wrongful death, occupational injury, property damage, eminent domain, and condemnation issues. We defend railroad companies in FELA and personal injury claims involving traumatic and occupational exposure, such as railroad asbestos, hearing loss, repetitive stress, and carpal tunnel syndrome.  We also defend railway companies in grade crossing and trespasser claims concerning train handling, visibility, and federal preemption.  Gallagher Sharp’s railroad attorneys are active members of the National Association of Railroad Trial Counsel (NARTC).

Trucking, Bus and Motorcoach+

Gallagher Sharp represents motor carriers, trucking companies, owner operators, drayage and freight haulers, bus (including school transportation) and motorcoach organizations, and their insurers in accident claims and lawsuits. We have a strong working knowledge of the complex legal and technical issues encountered in serious trucking and bus accidents, including regulations relating to hours of service, driver qualifications, vehicle inspection and maintenance, commercial driver license standards, and drug and alcohol testing.  As part of our immediate response capability we work with independent adjusting firms throughout the state in order to quickly gather facts.  We retain highly respected accident reconstructionists to document the scene and post-crash evidence, ECM, Qualcomm and similar data, and to serve as expert witnesses if necessary. We consult and advise our clients on DOT compliance, as well as FMCSRs, SafeStat, and CSA interpretation. Our trucking lawyers are frequent speakers and authors as well as leaders in industry associations such as the Trucking Industry Defense Association (TIDA), Claims and Litigation Management Alliance (CLM), and the Defense Research Institute (DRI).
