Partner Joe Santoro recently obtained a defense verdict for Norfolk Southern in a lawsuit filed pursuant to the Federal Employers’ Liability Act.
The lawsuit was filed by a Norfolk Southern trackman for injuries that allegedly occurred at work. The plaintiff alleged that Norfolk Southern was negligent in causing what he claimed to be serious and permanent injuries to his shoulder and elbow that resulted in a loss of earnings capacity of $1.4 million.
The case was tried over four days in Jefferson, Ashtabula County, Ohio. During closing arguments, the plaintiff’s counsel asked the jury for $14 million in compensatory damages. The jury returned a defense verdict in favor of Norfolk Southern, finding that Norfolk Southern was not negligent.
